Power of Attorney

Key Reasons Why Parents of College Students Need a Power of Attorney

Sending a child off to college is a significant milestone that comes with mixed feelings of excitement, pride, and concern. While your child is stepping into a new phase of independence, there are important legal safeguards to consider. One such safeguard is setting up a power of attorney (POA). This legal document can be crucial for managing unexpected situations and ensuring that parents are able to help their child effectively. Here are key reasons why parents need a power of attorney for their college student:

Medical Emergencies

Medical emergencies can happen at any time, and if your child experiences a medical emergency and is unable to make decisions, a healthcare power of attorney allows you to step in and make crucial healthcare decisions on their behalf. Without a POA, parents may face legal obstacles in accessing their child’s medical information and the ability to make necessary decisions due to privacy laws like the Health Information Portability and Accountability Act (HIPAA) which protects sensitive patient information.

Financial Management

College students often need help managing their finances. They may need assistance with paying for tuition, handling their bank accounts, and paying other bills. A financial power of attorney enables parents to manage their child’s financial responsibilities in a smooth fashion, ensuring that their bills get paid on time and keeping their finances in order.

Legal Matters

If a student happens to get involved in a legal issue, such as a lawsuit or a contractual dispute, a POA allows parents to represent their child’s interests and take the necessary actions by providing support in legal matters. This can be especially important if the student is studying far from home and unable to manage legal issues in their home state.

Continuity During Travel or Study Abroad

Many students take advantage of study abroad programs or extended travel opportunities. For those students who choose to study abroad or travel for extended periods, they may need someone to handle their affairs back at home. A POA gives parents the authority to manage their child’s financial and legal matters, along with any other unexpected issues that might arise while they are out of the country.

Accessing Education Records

Due to privacy laws like Family Educational Rights and Privacy Act (FERPA), parents may not have access to their child’s educational records. Once a student reaches the age of 18, the FERPA legislation imposes limitations on who can access their educational records. With a POA, parents can gain access to their child’s records, monitor their academic progress, and address any issues with the college, making sure that their child stays on track.

Emergency Situations

In cases of unforeseen emergencies, such as natural disasters or personal crises, students will need help with quick decision making. A POA ensures that parents can make prompt decisions and take actions on behalf of their child, guaranteeing their safety and well-being during such times.

Navigating Bureaucratic Processes

Navigating bureaucratic processes, such as renewing a driver’s license or dealing with governmental agencies, can be a challenging task for students. A POA allows parents to manage these processes efficiently, avoiding potential delays or complications.

Peace of Mind

Ultimately, having a power of attorney provides peace of mind for both parents and students. Knowing that there is a trusted person who can make important decisions, if necessary, can alleviate stress and anxiety for both parties, especially during times of crisis.

Establishing a power of attorney is a proactive step that gives parents the ability to support their college-aged child. It is important to plan for the unexpected to ensure that your child’s transition to independence while in college goes as smoothly and securely as possible.
